Class X Felony Charges: Non-probationable with 6 to 30 years in prison. Typical Class X felony offenses: unlawful possession of a controlled substance with intent to deliver, aggravated criminal sexual assault. predatory criminal sexual assault, aggravated battery with a firearm, home invasion, aggravated DUI (6th offense), etc.
Class 1 Felony Offenses: Probationable with 4 to 15 years in the Department of Corrections (DOC). Residential burglary is a Class 1 felony for which probation is not possible. Examples of Class 1 felonies: unlawful possession of a controlled substance, aggravated identity theft, aggravated discharge of a firearm, aggravated DUI (5th offense), etc.
Class 2 Felony Charges: Probation is possible, but 3 to 7 years prison is a sentencing range. Class 2 felonies include burglary, aggravated theft, aggravated driving under the influence (4th DUI offense), aggravated battery to a police officer, leaving the scene of an accident involving personal injury or death, etc.
Class 3 Felonies: Probationable with 2 to 5 years DOC. Deceptive practices, forgery, aggravated battery, aggravated theft, aggravated driving while license suspended or revoked, etc.
Class 4 Felony Offenses: 1 to 3 years in DOC. Generally, most Class 4 felonies result in probation, but this is not guaranteed. Typical charges include unlawful possession of a controlled substance, aggravated unlawful use of a weapon (agg UUW), DWLS and DWLR, unlawful possession of cannabis (and with intent to deliver), aggravated fleeing and eluding, obstruction of justice, unlawful use of a credit or debit card, aggravated reckless driving, etc.
Class A Misdemeanors: Up to 364 days in the county jail, but with a preferred outcome of community service in SWAP, probation, and fines. Typical Class A offenses include domestic battery, violation of an order of protection, unlawful interference with the reporting of domestic battery, violation of an order of protection, DUI, DWLS and DWLR, fleeing and eluding, street racing, reckless driving, retail theft, unlawful possession of cannabis, battery, resisting arrest, unlawful possession of drug paraphernalia, etc.
Class B Misdemeanors: Up to 180 days in the county jail, but this type of offense is probationable. Examples include telephone harassment, criminal trespass to land, driving without a valid driver's license, and possession of cannabis, etc.
Class C Misdemeanors: This type of charge has a maximum of 30 days in the county jail, but usually results in supervision. Examples of Class C misdemeanor offenses under Illinois law are disorderly conduct, unlawful possession of cannabis, etc.
